2021年4月14日付でカナダ移民局は、新たな永住権への申請方法として臨時のパスウェイを発表しました。カナダのポストセカンダリ教育機関からの卒業生やカナダでの労働者など、様々な永住権申請希望者がこのパスウェイカテゴリーに該当するかもしれません。以下に発表された内容を日本語でまとめています。
追記：以下の人数制限である90000人は英語の申請条件を満たしている申請者が対象であり、フランス語の条件を満たしている申請者への人数制限はないようです。

2021年4月14日 オタワ
本日、移民・難民・市民権省大臣マルコ・E・L・メンディチーノが、カナダ経済に積極的に貢献している90,000人以上のエッセンシャル・ワーカーおよび留学卒業生が永住権を獲得する為の画期的パスウェイ（措置）を発表しました。
この特別措置は、既にカナダ国内に滞在しており、パンデミックと闘うカナダの経済的回復を加速させる為に必要なスキルや経験を持つ永住権非所持エッセンシャル・ワーカーおよび留学卒業生に永住権を付与するものです。
今回の新措置は、カナダの病院や長期介護施設、市民生活を支える為に必要不可欠な職種の最前線で働いている永住権非所持エッセンシャル・ワーカー、そしてこの国の未来を担う留学生への永住権取得への道に主眼を置いています。
エッセンシャル・ワーカーとしての申請資格は、ヘルスケアの専門職またはその他の市民生活を支えるために必要不可欠であると認められた職種におけるカナダでの１年以上の就労経験です。留学生は2017年１月以降で現在から遡る過去４年以内にカナダでのポスト・セカンダリー教育を終えていることが必要になります。
移民・難民・市民権省は2021年5月6日より下記３種の申請の受け付けを開始します。
- ヘルスケア職での永住権非所持就労者 20,000人
- 市民生活を支えるために必要不可欠な職種での就労者 30,000人
- カナダの教育機関を卒業した留学生 40,000人
受け付け期間は2021年11月5日までですが、定員に達し次第受け付け終了となります。
カナダには複数の公用語がある為、フランス語または英仏バイリンガル話者用に上記３種の申請資格が適用されます。
パンデミックとの闘いが続く中、移民・難民・市民権省は労働者不足への注視と労働力増強による経済の回復を主軸と考えています。
永住権獲得への近道となる今回の特別措置では、市民生活を支える永住権非所持エッセンシャル・ワーカーや留学卒業生がカナダに根を下ろし、特にヘルスケア分野で必要とされる才能を持つ労働者の維持に有効となることでしょう。
本日の発表は、2021年には401,000人の新規移住者を受け入れるという移民・難民・市民権省の目標達成の一助となるはずです。移民プログラムで受け入れたスキルのある新規移民や留学生は、新規雇用の創造とカナダの長期的経済成長を牽引していってくれることでしょう。

- カナダは人口統計的な困難に直面している。1971年には年長者一人当たりに対する労働者比率は6.6人であったところが、今日では3人にまで減り、2035年には2人になる予測が出ている。新規移民を受け入れなければ、現行の公共制度を維持するために将来の労働世代が更なる負担を強いられることになる
- 2021年1月時点の統計によると就労ビザから永住権を取得した移民は、永住権取得後１年で所得額が上がっている傾向にあるという報告が出ている。
カナダのポストセカンダリー教育を最近修了した者に対する臨時永住権申請措置
以下の出典はこちらです。
申請者の条件
外国籍者は以下を満たす必要があります：
a) 永住権申請より前だが2017年1月より後に、カナダのDLI番号のある教育機関でプログラムの履修を完了している：DLIは規定のセクション1に書かれている通り、以下を含む：
- 公立のポストセカンダリー機関：カレッジ、トレード/テクニカル系の学校、ユニバーシティやケベックのCEGEP
- ケベックにあり、公立教育機関と同様の規定を利用している私立のポストセカンダリー
- ケベックにある私立や公立のポストセカンダリーで、900時間以上のDVSやAVSを得ることができるプログラムを提供している
- カナダの私立教育機関の中で、州法に基づき学位を授与することが認められている学校であり、修了したプログラムが州で認められた学位である場合。その私立の教育機関で提供されているすべてのプログラムが満たすわけではない。
b) 上記に該当する教育機関でプログラムの履修を完了し、以下の学位を得ている：
- ディグリー（準学士号、学士号、修士号、博士号）であり、8か月以上のプログラムの履修完了による学位である場合
- ディグリー、ディプロマ、サーティフィケートやアテステーションであり、スキルドトレード（Annex A【詳細下部】にリストされている）の職業につながるプログラムの履修完了による学位である場合
- 以下の条件を満たす1つ以上のディプロマ/ サーティフィケート/ アテステーションである場合：
- ディプロマ/ サーティフィケート/ アテステーションの場合、それぞれのプログラムの期間が8か月以上であり、すべての学位を合わせた長さが2年の学位と同等である（最低16か月間）である場合
- DVSやAVSの場合、それぞれのプログラムの期間は900時間以上であり、すべてのプログラムの合計が1800時間以上である場合。
- 1つのAVSと1つのDVSを合わせる際、合計が1800時間以上である場合、AVSが900時間以下にもなりえる。
- それぞれの学位はa)の部分で明記されている申請条件を満たす必要があり、2017年1月より前にプログラムの履修を完了していないこととする
c) 法と規則に基づき、カナダで教育を受けることを許可された者であった場合
d) 永住権申請が受理された時点で、法や規則に基づいた有効な許可証または認可の元、カナダで雇用されており、また、医療機関とのフィーフォーサービス契約で医師として働いている場合を除き、自営業ではないことを満たす。雇用は、規定の73(2)項の仕事の定義を満たしていなければならない。
e) カナダランゲージベンチマークまたはNiveaux de compétence linguistique canadiensに記載されている4つの言語スキル分野のそれぞれについて、いずれかの公用語でベンチマーク5以上の言語能力を達成していること。これは、規定の74項(3)に基づいた言語能力を評価する目的で大臣が指定した組織または機関による評価の結果によって証明されなければならず、また、その評価は永住権申請書を受け取った時点で2年以内のものでなければなりません。
f) 有効な一時居住者の資格を持ってカナダに居住しており（または資格を回復する資格を持っている）、永住権申請書が受理された時点および申請書が承認された時点でカナダに物理的に存在していること。
g) ケベック州以外の州または地域に居住する意思があること。
h) この公共政策用に省庁が提供するフォームを使用して永住権申請書を提出しており、申請時に申請者がこの公共政策の条件（資格要件）を満たしていることを担当官に納得させるために必要なすべての証拠（申請承認時にカナダに物理的に存在していることを証明するために必要な証拠を除く）を添付しなければならない。
i) この公共政策に基づく永住権申請書を電子的手段（オンライン申請）で提出していること。障害のために電子的手段による申請、書類の提出、署名や情報の提供の要件を満たすことができない外国籍者は、その目的のために大臣が利用可能にした、または指定したその他の手段で本申請書を提出することができる；さらに、
j) その外国籍者が、法令に基づいて入国を認められてないことでない場合。
外国籍者は、この公共政策の条件を満たしているかどうかを評価するために必要なすべての裏付け書類を申請時に提出しなければなりませんが、担当官は、申請の処理中に、受け入れ許可と申請条件を確認するための追加の裏付け書類を申請者に要求する裁量権を保持しています。

受け入れ人数
申請には、最大40000人の申請者が受け入れられる予定です。
費用
永住権申請手続きや、法25.2(1)項に基づく永住ビザ申請手続きのための料金、永住権料金など、適用される料金は、申請時にお支払いいただく必要があります。
開始日・終了日
この公共政策は、2021年5月6日に発効し、2021年11月5日まで、または、4万件の申請が受理された時点のいずれか早い方で終了します。 すべての公共政策と同様に、この公共政策は、事前の通知なしに、大臣によって取り消される可能性があります。
2021年5月6日以降、2021年11月5日までの間、または失効日（該当する場合）に、この一時的な公共政策に基づいて受理された申請は、受理上限にしたがって処理されます。 40,000人の受け入れ上限に達した後に受け取った申請は、処理されません。

生活を支えるのに必要不可欠な職種従事者に対する臨時永住権申請措置
以下の出典はこちらです。
下記の条件に当てはまる外国人に永住権資格（Permanent Resident Status）が付与される可能性があります。
a) 永住権申請する時点から過去3年以内に、カナダ国内において、Annex AまたはAnnex Bの職種で、最低1年間フルタイムまたはパートタイム（1,560時間以上）で働いていた経験がある。1年の就労経験は、条件に当てはまっている職種一つで、または複数の職種での就労経験の合計期間である必要があります。職種条件：
- Stream A：Annex Aに含まれる一つまたは複数の職種で計1年の就労経験がある。ただし、Annex Bの職種の就労経験を含むことはできません。
- Stream B：Annex Bに含まれる一つまたは複数の職種で計1年の就労経験がある、またはAnnex Aの職種での就労経験とAnnex Bの職種での就労経験の合計1年を満たす
b) 永住権に申請する時点で、職種問わずカナダ国内で就労している
c) 上記a)と b)で記載されている就労が、the Regulationsの73(2)の説明に沿っていて、the Actand Regulations の規定に従っている必要があります。かつ、保険当局と連携して出来高払いで働いている医師でない限り、自営業は認められません。
d) the Canadian Language BenchmarksまたはNiveaux de compétence linguistique canadiensに記載されている4つの言語スキル分野のそれぞれについて、いずれかの公用語でベンチマーク5以上の言語能力を達成していること。これは、規定の74項(3)に基づいた言語能力を評価する目的で大臣が指定した組織または機関による評価の結果によって証明されなければならず、また、その評価は永住権に申請した時点から過去2年以内のものでなければなりません。
e) 永住権申請を行う際と申請が承認された際、カナダ国内にいて、かつ有効な滞在・居住許可ビザ（または復元可能なビザステータス）を保有していること
f) ケベック州以外の州または準州に住む予定
g) この臨時永住権申請措置のために政府が提供するフォームを使用して永住権申請行っており、この臨時永住権申請の資格・条件を満たしていると担当官を納得させるのに十分な証拠（申請承認時にカナダに滞在していることを証明するために必要な証拠を除く）を提出していること。
h) この特別措置に基づく永住権申請をオンライン上で行っていること。障害のためにオンライン上での申請、書類の提出、署名や情報提供ができない申請者は、特別にほかの手段で申請することが許可されます。; 及び
i) 申請者がthe Act and Regulationsに基づいてカナダ入国を認められている
申請者はこの臨時永住権申請の対象になることを担当官に納得させるために、必要とされる全ての証拠（申請承認時にカナダに物理的に存在していることを証明するために必要な証拠を除く）を提出することが求められます。また担当官は申請者を審査する上で必要であれば、追加で書類を求めることもあります。
受け入れ人数
- Stream A – 最大20，000人まで申請できます。
- Stream B– 最大30，000人まで申請できます。
どちらかのStreamが最大人数に達してしまった場合でも、もう一つのStreamは申請者を受け付けます。
費用
the Actの中の25.2(1)に記載されている永住権申請費やthe Right of Permanent Residence費などといった永住権申請に必要となる全ての費用は、永住権申請時に支払われる必要があります。
開始と終了日
この臨時永住権申請措置は2021年5月6日から有効になり、2021年11月5日または最大受け入れ人数に達し次第終了します(Stream Aの最大受け入れ人数は20,000人、Stream Bの最大受け入れ人数は30,000 人)。ほかのどの政策と同様で、この措置は大臣の判断により予告なく変更となる場合があります。
2021年5月6日から2021年11月5日までの間、または失効日（該当する場合）に、この臨時永住権申請措置に基づいて受理された申請は、受理上限にしたがって処理されます。受け入れ上限に達した後に行われた申請は処理されません。
